Legislator-Zusammenfassung

The Federal Administrative Court granted leave to appeal, reversing the lower court's implicit refusal and directing that the case proceed to revision due to its fundamental significance. The dispute concerned municipal planning law, specifically whether a municipality is legally obligated to re-expose the draft of a detailed land-use plan for public and authority consultation under the Building Code if the accompanying environmental report is modified after the initial participation phases have concluded. The decisive legal basis involves §§ 132(1), 133(1), and 132(2)(1) of the Administrative Court Rules (VwGO), combined with §§ 4a(3) sentence 1 and 3(2) of the Building Code (BauGB), establishing the procedural requirements for revisiting planning documents when environmental assessments are amended.

Revisionszulassung; erneute Auslegung des Bebauungsplans nach Änderung des Umweltberichts

[GRUENDE]
