The Federal Administrative Court ordered the admission of the plaintiff's appeal on points of law, thereby allowing the case to proceed to the Supreme level of judicial review, with the interim amount in dispute set equal to that of the prior instance. The dispute centers on the temporal extent of compensatory leave required to offset lawful overtime performed in the form of on-call duty, a question identified as having fundamental legal significance due to pending related appeals from other defendants. The decision relies on § 132(2) No. 1 VwGO for the standard of admissibility and §§ 63(1) Sentence 1, 52(1)-(2) GKG for the calculation of the amount in dispute.
