The Federal Administrative Court (BVerwG) granted permission for an appeal on points of law, allowing the plaintiff's complaint to proceed to the revision stage for substantive review. The case involves a norm control action challenging a zoning plan (Bebauungsplan), centered on whether a claimant who made no objections during the public display period is precluded from raising new legal grounds under § 47 Abs. 2 VwGO when those grounds are based on factual circumstances that arose chronologically after the plan's public display. The decisive legal basis is § 132 Abs. 2 Nr. 1 VwGO, which permits an appeal if the case has general legal significance, specifically to clarify the conditions under which such temporal preclusion applies in administrative norm control proceedings.

Revisionszulassung; Präklusion nach § 47 Abs. 2 VwGO bei nach Auslegung eintretenden Sachverhalten

[GRUENDE]
