The Federal Administrative Court (BVerwG) granted the applicant's leave to appeal, finding the complaint well-founded under § 132(2) No. 1 VwGO and setting a provisional amount in dispute of €7,500 for the revision proceedings. The dispute concerns a challenge to a preliminary building permit issued by the competent authority after substituting the municipal consent that was required under § 14(2) Sentence 2 BauGB but refused by the municipality. The court ordered the revision to clarify a significant legal question: the specific point in time that determines the applicable factual and legal situation when the legal landscape changes during the pendency of the administrative litigation, specifically in cases where a municipality contests a permit granted despite its refusal of consent.
