Legislator-Zusammenfassung

KI-generiert

The Federal Administrative Court allowed an appeal on points of law, granting the defendant (defendant-landowner) a successful challenge to the lower court's denial of such permission, thereby paving the way for a full review of the case by the senior senate. The dispute concerned whether a step-by-step construction of an access facility, involving the simultaneous implementation of provisional measures, could trigger immediate liability for subdivision charges. The court based its decision on the principle of "basic significance" under § 132 Abs. 2 Nr. 1 VwGO, holding that the subdivision charge implications of phased infrastructure development and the legal status of interim measures remain unclear and require clarification by the appellate panel.
