Eligibility of structurally non-reimbursable hospital services in arbitration budget allocations under § 13 KHEntgG
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) granted the plaintiffs' complaints and authorized an appeal to the Court of Appeals on grounds of fundamental legal significance, effectively allowing the case to proceed to the merits rather than denying the lower court’s ruling. The dispute concerns a billing conflict regarding hospital service budgets under the Hospital Remuneration Act (KHEntgG), specifically whether the arbitration board may include in the revenue budget services whose general ("structural") billability to payers was doubtful and unresolved in social courts at the time of its decision. The court identifies the decisive legal issues as whether such inclusion is permissible and whether the subsequent judicial approval of the arbitration award (§ 14 KHEntgG) becomes unlawful if social courts later determine that the relevant services lacked the structural prerequisites for remuneration, thereby affecting the validity of the approved budget allocation.

Revisionszulassung; Berücksichtigung des Erlösbudgets von der Schiedsstelle bei Festsetzung von Krankenhausleistungen; Abrechnungsstreit
[GRUENDE]
