Compatibility of the Saarland exclusion of objections in administrative proceedings with EU law
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) granted the plaintiff's leave to appeal in revision, finding the admissible complaint justified on grounds of fundamental significance. The dispute concerns the compatibility of § 73(4) sentence 3 of the Saarland Administrative Procedure Act (SVwVfG), which excludes certain objections, with European Union law, a question necessitating clarification due to a pending infringement proceeding by the European Commission against the Federal Republic of Germany (CJEU Case C-137/14). The court ordered that the revision proceedings proceed, prioritizing the fundamental legal question over the specific merits of the individual case.

Die Festsetzung des Streitwerts beruht für das Beschwerdeverfahren auf § 47 Abs. 1 Satz 1, Abs. 3, § 52 Abs. 1 GKG, für das Revisionsverfahren auf § 47 Abs. 1 Satz 1, § 52 Abs. 1, § 63 Abs. 1 GKG.
