Legislator-Zusammenfassung

The Federal Administrative Court granted leave to appeal a municipal ordinance establishing compulsory connection and use of a district heating system, ruling that the case involves a question of fundamental importance for the law. The dispute centered on whether the Federal District Heating Act (§ 16 EEWärmeG) permits local authorities to impose such mandatory usage requirements on individuals solely based on the general suitability of district heating for climate protection, or whether the specific municipal facility must demonstrate a concrete local contribution to reducing CO2 emissions within its jurisdiction. The decisive legal issue is the interpretation of § 16 of the Federal District Heating Act (EEWärmeG), specifically whether an additional requirement of local, concrete emission reduction is a prerequisite for the validity of compulsory connection and use ordinances.
