Admissibility of operational noise protection orders in a railway plan approval decision under § 18 AEG
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court partially granted the defendants' and intervenor's appeals against the higher administrative court's judgment, ordering that revision proceedings be permitted regarding the claims of the fourth plaintiff, while dismissing the appeals concerning the first to third plaintiffs, leaving their favorable judgments intact. The case involved a legal dispute over a railway installation where the defendant challenged a plan approval decision that included operational noise protection orders. The Court found that the question of whether and under what conditions operational orders for noise protection can be issued within a plan approval under § 18 AEG has fundamental significance, whereas for the other plaintiffs, the issue was moot because the lower court had already deemed them precluded from raising claims regarding speed restrictions under § 18a No. 7 AEG without their appeals addressing this specific legal basis.

[GRUENDE]
§ 52 Abs. 1 GKG.
