Compatibility of statutory exclusion of environmental objections with EU law
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court dismissed the defendant’s opposition and granted leave to appeal the lower court’s judgment, allowing the plaintiff to pursue the revision. The case concerned a dispute under environmental law where the plaintiff challenged the finality of the administrative act based on a procedural defect. The court held that the case had fundamental significance because it required clarification on whether the statutory exclusion of objections in German environmental law is compatible with European Union law. The decision is grounded in § 132 Abs. 2 Nr. 1 VwGO (federal administrative procedure code) and addresses the compatibility of § 10 Abs. 3 Satz 5 BImSchG (Federal Immission Control Act) and § 2 Abs. 3 UmwRG (Environmental Remediation Act) with EU law.
