Cost allocation for a withdrawn cross-revision under German fiscal procedure
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Finance (BFH) ordered the dismissal of the proceedings after the defendant tax office withdrew its revision, ruling that the defendant must bear the costs of the revision proceedings, including the costs of the plaintiff’s subsequent cross-revision. The dispute arose from a tax case where the tax office successfully appealed a lower court judgment, and the plaintiff subsequently filed a cross-revision on the same day the tax office withdrew its own revision. The court held that the cross-revision became moot upon the withdrawal of the main revision but that the withdrawing party remains liable for the costs of the admissible cross-revision under consistent case law. This ruling was based on Sections 121 and 125 of the Fiscal Court Code (Finanzgerichtsordnung) regarding the effects of withdrawal, and Sections 136 and 143 regarding cost allocation, rejecting the argument that simultaneous filing of the cross-revision and withdrawal justified shifting costs to the plaintiff.

Kosten der Anschlussrevision bei Revisionsrücknahme
[LEITSATZ]
