Admissibility of nullity action for alleged arbitrary breach of EU reference obligation under Art. 267 TFEU
Legislator-Zusammenfassung
KI-generiertIn this procedural ruling, the Federal Fiscal Court (BFH) did not render a final judgment on the merits but instead issued a binding divergence inquiry to the IV, VIII, and XI Senates of the BFH, asking whether they would maintain their prior positions; consequently, the pending case IX K 1/21 remains undecided while the higher-level conflict is resolved. The dispute centers on the admissibility (Statthaftigkeit) of a nullity action (Nichtigkeitsklage) based on an alleged lack of competent court composition, specifically challenging whether a lower appellate court’s arbitrary failure to refer a question to the Court of Justice of the European Union (CJEU) under Article 267 TFEU constitutes a sufficient procedural defect to invalidate a judgment. The decisive legal basis involves the application of § 134 of the Fiscal Court Ordinance (FGO) in conjunction with § 579(1)(1) of the Code of Civil Procedure (ZPO) for nullity actions, and § 11(3)(1) FGO, which mandates the referral of diverging interpretations of law among different senates to ensure uniformity in the interpretation of the CJEU referral obligation.

[LEITSATZ]
