Mootness of reference on strict versus modified separation theory for gains from partially compensated transfers following full administrative abatement of claim
Legislator-Zusammenfassung
KI-generiertThe Federal Fiscal Court (BFH) terminated both the pending revision proceedings and the related reference to the Grand Senate without deciding the substantive legal question, as the defendant tax authority fully complied with the plaintiffs' claims via an amended assessment order of October 2, 2018, leading both parties to declare the dispute moot; this procedural termination resolved a tax case concerning the calculation of potential gains from partially compensated transfers, where the core issue was whether to apply the strict or modified separation theory, and the court applied §§ 138(2) sentence 1 and 143(1) of the Fiscal Courts Code (FGO) to assign the costs of the entire proceedings to the tax authority, rendering the prior judgment of the Finanzgericht Baden-Württemberg from May 23, 2012, devoid of effect.
