Admissibility of revision appeal challenging lower court's factual application of dissolution loss recognition timing under § 17 EStG
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BFH) dismissed the taxpayer's non-admission complaint, upholding the Lower Federal Court's decision and rejecting the taxpayer's arguments, thereby leaving the lower court's judgment in force. The dispute concerned the timing for recognizing a dissolution loss under § 17(4) of the Income Tax Act (EStG), where the taxpayer alleged that the Lower Federal Court had erroneously applied the tax code to the specific facts of the case. The BFH held that the legal question regarding the timing of such losses was already settled by established case law and that the lower court correctly applied these principles; the court further ruled that the taxpayer’s objection amounted to a disagreement with the factual and legal assessment by the lower court, which does not satisfy the requirements for admitting a revision appeal under § 115(2) of the Fiscal Court Code (FGO).
