Legislator-Zusammenfassung

KI-generiert

The Federal Finance Court (BFH) dismissed the taxpayer’s non-acceptance complaint as unfounded, resulting in the lower court judgment from the Cologne Finance Court remaining in force and the taxpayer bearing the procedural costs. The dispute concerned the carry-forward of losses under § 10d Abs. 2 Satz 1 EStG into assessment periods where the taxpayer’s income fell below the basic tax-free allowance (§ 32a Abs. 1 Satz 2 Nr. 1 EStG), with the taxpayer arguing for fundamental legal significance and further legal development to justify admission of an appeal. The court held that the issue was already settled by existing BFH jurisprudence, which permits such loss carry-forwards regardless of whether a non-assessment certificate was issued, as the certificate solely governs the abatement of wage tax deduction under § 44a EStG and is irrelevant to the loss carry-forward rules, thereby negating both grounds for admission of the revision.

Verlustvortrag bei einem Einkommen unterhalb des Grundfreibetrags

[LEITSATZ]
