Procedural ineffectiveness of unauthorized representative's submissions in mandatory representation proceedings; substantiation requirements for hearing objections
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Finance (BFH) dismissed the objection to the denial of hearing (Anhörungsrüge) as inadmissible, leaving the prior Senate order that rejected the non-admission complaint unchanged. The dispute concerned whether the taxpayer's arguments, submitted by a business executive acting "on behalf" of the authorized attorney, could be considered valid for the purpose of establishing that the court had violated the right to be heard regarding a alleged legal divergence. The court held that the filing was procedurally ineffective because the representative lacked postulation capability at the BFH, and acting under the attorney's instruction did not cure this defect given the mandatory representation requirement in proceedings before the BFH. Relying on § 133a Abs. 1 and 2 Satz 5 FGO for the strict substantiation requirements of the objection, and § 62 Abs. 4 i.V.m. Abs. 2 Satz 1 FGO for the admissibility of submissions under mandatory representation, the court ruled that the unauthorized filings were disregarded, resulting in a failure to substantiate the claim of a violation of the right to be heard.

[TATBESTAND]
Gräber/Stapperfend, a.a.O., § 62 Rz 56).
Juli 2013, BGBl I 2013, 2586). Es fällt eine Festgebühr von 60 € an.
