Unitary object of acquisition in real property transfer tax: rejection of divergent lower court doctrine on unified acquisition of property rights
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Finance (BFH) denied the taxpayer’s complaint, refusing to grant leave for a revision appeal, thereby upholding the lower court’s decision. The dispute concerned the concept of a "unitary object of acquisition" in real property transfer tax, specifically challenging the lower court’s deviation from established case law. The BFH held that the matter lacked fundamental legal significance and did not require further legal development because the Court had already settled the issue in a subsequent decision dated 28 March 2012, which explicitly rejected the lower court’s divergent view from 26 August 2011 and affirmed the prevailing doctrine regarding the unitary nature of acquired rights in property transactions.
