Cost allocation in non-admission complaint where partial administrative resolution renders part of the case moot
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Finance (BFH) dismissed the taxpayer's non-admission complaint as unfounded regarding tax years 1999, 2000, 2005, and 2006, while declaring the main proceedings moot for 2001–2004 after the tax office issued a corrected assessment that fully granted the taxpayer's claims; the taxpayer prevailed on the merits for 2001–2004 due to the administrative accommodation, whereas the tax office prevailed on the procedural admissibility and substantive rejection for the remaining years. The dispute concerned the allocation of legal costs in a mixed outcome where part of the case was resolved by administrative change during the appellate proceedings and part remained subject to judicial review. The decisive legal basis included § 115(2) No. 1 and 3 and § 116(3) Sentence 3 FGO for denying the revisionary appeal due to lack of fundamental significance and insufficient substantiation of procedural defects, and §§ 135(2) and 138(2) Sentence 1 FGO for the cost allocation, where the tax office was ordered to bear the costs for the portion of the case resolved by its corrective action, while the taxpayer bore the costs for the unsuccessful remainder.
