Legislator-Zusammenfassung

KI-generiert

The Federal Court of Finance (BFH) dismissed the plaintiff-taxpayers' complaint for non-admission of appeal, upholding the lower court's decision. The dispute concerned whether the principle of good faith (Treu und Glauben) precluded the tax authority from considering subsequently discovered facts for the purpose of suspending the statute of limitations under § 171(8) sentence 1 of the Fiscal Code (AO). The BFH held that the application of good faith is contingent on the specific circumstances of individual cases and is not amenable to a general clarification, thereby finding no fundamental legal significance for the appeal. Furthermore, the court reaffirmed that the precedents regarding good faith in the context of correcting tax assessments under § 173(1) No. 1 AO are not transferable to the limitation suspension provisions of § 171(8) AO, and determined that the specific legal question raised was not decisive in the underlying case.

(Grundsatz von Treu und Glauben; Ablaufhemmung nach § 171 Abs. 8 Satz 1 AO)

[LEITSATZ] 1.
