Ineffectiveness of Non-Admission Complaint Filed Without Guardian Consent Under Legal Guardianship and Deletion of Proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Fiscal Court ordered the deletion of the non-admission complaint from its registers, finding it was not effectively filed and ruling that no cost allocation is provided for such a deletion decision. The case involved a challenge to a prior decision in tax proceedings where the complainant was subject to legal guardianship for judicial and administrative matters, with a specific consent requirement (Einwilligungsvorbehalt) for legal declarations in that scope; the complainant filed the complaint without the mandatory consent of the guardian, and the guardian did not provide after-the-fact authorization. The decisive legal basis is § 58 Abs. 3 of the Fiscal Court Rules of Procedure (FGO) in conjunction with §§ 1896 and 1903 of the Civil Code (BGB), which establishes that procedural acts are ineffective without the guardian's consent when a consent requirement is in place, rendering the complaint void.

[GRUENDE]
