Legislator-Zusammenfassung

The Federal Court of Finance (BFH) dismissed the complaint, upholding the lower court’s correction of its judgment for an obvious error. The dispute concerned a correction order issued to amend the judgment of the 16th of November 2011, specifically because the factual findings section failed to list the substantive claims filed by the parties during the oral hearing. The BFH held that the omission of these claims constituted an "obvious inaccuracy" (offenbare Unrichtigkeit) under § 107 para. 1 of the Fiscal Courts Code (FGO), which covers all components of a judgment, including missing claims, provided the correction merely restores the court’s intended will without altering the substantive decision. The court established that when claims are omitted or deviate from the official record, the applications recorded in the session protocol are determinative, based on the combination of § 155 FGO and § 314 sentence 2 ZPO.

Offenbare Unrichtigkeit, Beschwerde gegen Berichtigungsbeschluss

[LEITSATZ] 1. NV: Eine offenbare Unrichtigkeit i.S.v.

§ 314 Satz 2 ZPO; vgl. BFH-Urteile vom 18. Juni 1993 VI R 67/90, BFHE 171, 515, BStBl II 1994, 182; vom 25. Januar 2001 II R 22/98, BFHE 194, 440, BStBl II 2001, 456).
