The Federal Court of Finance (BFH) ruled that the main subject matter of the dispute was settled (erledigt) due to the parties' mutual agreements following the Federal Fiscal Office's amendment of the contested assessment notice in light of constitutional court rulings, thereby rendering the lower court’s judgment and its cost order moot and leaving only the allocation of litigation costs to be decided, with the plaintiff prevailing on costs as the defendant had amended the notice at the plaintiff's request. The case concerned the sale of a business on March 31, 1999, and the application of the half tax rate under § 17 EStG, which had been challenged on grounds of unconstitutionality. The decision relies on the doctrine of settlement of the main issue (Erledigung der Hauptsache) and applies § 138 Abs. 2 Satz 1 of the Fiscal Court Ordinance (FGO) to determine that the party whose claims were ultimately granted through the administrative amendment is entitled to the costs.
