Scope of mandatory legal representation for applications to review court record access denials under § 86(3) FGO
Legislator-Zusammenfassung
KI-generiertThe Federal Fiscal Court (BFH) dismissed the application as inadmissible, ruling that the applicant failed to satisfy the mandatory representation requirements for proceedings before the BFH. The dispute arose in a main case concerning the legality of a tax assessment notice for a community of heirs, where the applicant personally filed an application under § 86 para. 3 FGO regarding the tax court's refusal to provide specific tax records and copies. The court held that the mandatory requirement for legal representation applies to all procedural actions that initiate proceedings before the BFH, including such applications for review, and since the applicant did not act through a qualified attorney, tax advisor, or other authorized representative as required by § 62 para. 4 FGO, the application was procedurally invalid.
