Tax litigation cost allocation and pre-trial representation jurisdiction when main proceedings are settled during appellate review
Legislator-Zusammenfassung
KI-generiertThe Federal Finance Court (BFH) dismissed the appeal as moot following the taxpayer’s full victory on the merits, ruling that the lower court's judgment was rendered moot upon the defendant's concession of the claim; the court ordered the defendant to bear all litigation costs and determined that the lower Finance Court retained exclusive jurisdiction to decide whether the taxpayer's appointment of a legal representative in the pre-trial administrative proceedings was necessary. The dispute arose from a VAT litigation where, after a non-admission complaint was pending before the BFH, the defendant issued amended tax assessments for the 2000 and 2001 fiscal years fully satisfying the plaintiff’s original claims, leading both parties to declare the main proceedings concluded. Key legal grounds include §§ 138 and 143 of the Financial Courts Act (FGO), which govern the procedural status of judgments when the subject matter is settled by the parties during appellate review and the allocation of costs to the party whose administrative action led to the resolution, alongside the precedent that the determination of the necessity of pre-trial representation under § 139 Abs. 3 Satz 3 FGO remains within the competence of the first-instance Finance Court even when the settlement occurs at the appellate level.

BFH-Beschluss vom 25. Januar 1994 V R 128/85, BFH/NV 1995, 918).
