Extinction of interest in legal protection following defendant's oral promise to issue corrective order; failure to substantiate impact of excessive procedural duration
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Finance (BFH) dismissed the plaintiff's complaint against the non-admission of revision, upholding the lower court's ruling and thereby establishing that the plaintiff did not prevail. The dispute involved a tax proceeding where the plaintiff challenged the lower court's decision to dismiss the lawsuit as inadmissible due to a lack of interest in legal protection, alleging procedural defects such as excessive procedural duration and the improper use of a procedural judgment instead of a substantive one. The decisive legal basis for the decision was the requirement under § 115 Abs. 2 Nr. 3 FGO for the complaint to specify how the outcome would have differed had the lower court decided earlier, combined with the doctrine that a defendant's oral promise in the hearing to issue a corrective administrative order matching the plaintiff's claims extinguishes the interest in legal protection under § 40 Abs. 2 FGO, thereby justifying the dismissal of the case as inadmissible rather than a procedural error.

Überlange Verfahrensdauer - Wegfall des Rechtsschutzinteresses nach Änderungszusage - Prozessurteil als Verfahrensmangel
[LEITSATZ] 1.
