Legislator-Zusammenfassung

The Federal Court of Finance dismissed the taxpayer's complaint, upholding the lower court's decision and ruling in favor of the tax authority. The dispute concerned whether the multi-year inactivity of the tax office during the objection procedure violated the right to effective legal protection or rendered the tax assessment unlawful. The court held that the complaint was inadmissible regarding the argument about tightened taxation via a 1983 ministry letter due to insufficient specification of admissibility grounds, and that the issue of excessive duration lacks fundamental significance. Citing established jurisprudence, the court reaffirmed that prolonged inactivity by the tax office in the objection phase does not result in the unlawfulness of the tax assessment, and found no procedural error in the swift conduct of the proceedings before the lower court.

Jahrelange Untätigkeit des FA

[LEITSATZ]

Dezember 2004 I B 163/04, BFH/NV 2005, 895).

3. Im Übrigen ergeht die Entscheidung nach § 116 Abs. 5 Satz 2 FGO ohne Darstellung vom Sachverhalt.
