Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court (Second Senate, First Chamber) dismissed the applicant’s request for a provisional order (einstweilige Anordnung) in a constitutional complaint proceeding, with the decision being final and unappealable. The case involved a complaint where the applicant failed to substantiate that the underlying constitutional complaint was neither inadmissible nor manifestly unfounded, specifically lacking a demonstration of a possible violation of the identified fundamental rights. The decisive legal basis for the dismissal was the failure to meet the substantive disclosure requirements of § 23 para. 1 sentence 2 and § 92 of the Federal Constitutional Court Act (BVerfGG), which mandate a specific showing of the potential for a rights violation to justify interim relief.

[TENOR]
