Reimbursement of out-of-pocket expenses for unsuccessful constitutional court application for interim relief: lack of special equity grounds
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court chamber rejected the applicant's request for the reimbursement of necessary expenses, thereby dismissing the petition and leaving the applicant to bear their own costs. The dispute concerned an application for reimbursement of legal fees incurred during a prior proceeding in which the applicant had sought a temporary injunction (einstweilige Anordnung) that was subsequently denied by court order on August 25, 2025. The decision relied on § 34a para. 3 of the Federal Constitutional Court Act (BVerfGG), holding that while reimbursement of expenses for unsuccessful applications is possible at the court's discretion, it requires specific justifications of equity (Billigkeitsgründe), which the applicant failed to demonstrate or which were not apparent, rendering the decision final and unchallengeable.
