Constitutional complaint rejected for lack of substantiation; refusal of admission of non-lawyer assistant as procedural representative
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court denied the applicant's motion for admission as a legal assistant and refused to accept the constitutional complaint for decision, rendering the request for interim relief moot. The dispute centered on the admissibility of the constitutional complaint and the necessity of auxiliary legal representation; the applicant had previously served as an authorized representative in cases that resulted in unreasoned non-acceptance decisions. The Court held that the motion for admission was denied because the applicant failed to demonstrate objective necessity or subjective requirement, noting that prior unreasoned non-acceptances did not imply a valid admission since such decisions require specific reasoning not covered by the statute permitting unreasoned rulings. The constitutional complaint was declared manifestly inadmissible for failing to meet the substantive requirements of § 23 (1) and § 92 BVerfGG regarding valid filing and sufficient substantiation of the constitutional argument.

Nichtannahmebeschluss: Parallelentscheidung
[TENOR]
