Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court (Second Senate) declared the election scrutiny complaint moot and ceased to provide a substantive written justification, thereby effectively leaving the challenged legislative act in force without a ruling on the merits. The dispute concerned a challenge to alleged violations of the constitutional principles of equal and direct elections under the Federal Election Act, which the complainant argued persisted despite a subsequent amendment to the law. The Court determined that the matter had rendered itself obsolete for the reasons identified in a prior reporter’s letter dated October 22, 2024, and found that the complainant’s arguments did not call into question the Senate’s earlier decision of July 30, 2024 (Case 2 BvF 1/23 et seq.); consequently, pursuant to § 24 Sentence 2 of the Federal Constitutional Court Act (BVerfGG), the Court dispensed with further written reasoning.

Die Wahlprüfungsbeschwerde hat sich aus den in dem Schreiben der Berichterstatterin vom 22. Oktober 2024 genannten Gründen erledigt.
