Denial of legal aid for constitutional complaint due to lack of plausible fundamental rights violation
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court's First Senate, Second Chamber, dismissed the applicant's request for legal aid and appointment of counsel for a planned constitutional complaint, finding no prospect of success. The dispute concerned the applicant's financial inability to pursue a constitutional complaint and the subsequent application for legal aid under the corresponding provisions of the Code of Civil Procedure. The court held that the applicant failed to demonstrate a sufficient prospect of success, as no violation of fundamental rights or equivalent rights was plausibly identified or otherwise apparent. The decision, which is final and unappealable, relied on the doctrine that legal aid for a constitutional complaint is only granted if the underlying legal action offers a sufficient chance of success and is not frivolous, standards the applicant did not meet.
