Mootness of judge's reference on constitutionality of civil servant salary scales following prior unconstitutionality ruling under the career principle
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court (Second Senate, First Chamber) declared the proceeding moot (erledigt) without issuing a substantive ruling on the merits, as the underlying constitutional challenge was resolved by a prior landmark judgment. The case involved a judge’s reference concerning the constitutionality of the Federal State of Berlin’s salary scales (Besoldungsordnungen A) for civil service pay grades A4 and A5 during specific periods between 2016 and 2019, which were allegedly incompatible with the career principle. The reference became obsolete following the Court’s earlier decision in the pilot case, which found the relevant Berlin salary regulations for 2008–2020 unconstitutional under the career principle (Art. 33(5) German Basic Law) and ordered the state legislature to enact compliant regulations by March 31, 2027, pursuant to §§ 82(1), 79(1), 31(2), and 13(11) of the Federal Constitutional Court Act (BVerfGG).
