Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court declared the election review complaint moot and did not provide further reasoning, thereby upholding the status quo without a substantive ruling on the merits. The case involved an election review challenge where the complainants also filed a setup objection (*Besetzungsrüge*), arguing that the court's composition violated European law. The Court dismissed the setup objection de novo, determining that the composition was lawful under the Basic Law and that allegations of incompatibility with European law were inherently unsuitable to establish a defect in the court's composition. Citing the reasons set out in the rapporteur’s letter, the Court applied § 24 Sentence 2 BVerfGG to refrain from further substantive analysis of the election review complaint.
