Admission of legal representative in constitutional complaint: insufficient demonstration of legal qualification
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court (1st Senate, 3rd Chamber) rejected the application to admit a representative and declined to hear the constitutional complaint, leaving the underlying decision in force. The case involved a request for the admission of a legal representative in a constitutional complaint proceeding, where the complainant alleged that the desired representative possessed sufficient legal qualifications to act on their behalf. Relying on § 22 (1) sentence 4 of the Federal Constitutional Court Act (BVerfGG), the court determined that admission must be objectively useful and subjectively necessary; it found that objective usefulness was not evident because the submitter failed to demonstrate or substantiate the representative’s sufficient legal qualification, leading to the rejection of the request without further reasoning under § 93d (1) sentence 3 BVerfGG.
