Constitutional complaint against administrative ruling on naturalization denial; sufficiency of continued litigation after opposing legal stance negates violation of right to effective legal protection despite factual errors
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court of Germany’s Second Senate declined to accept the constitutional complaint for decision, thereby leaving the lower administrative court’s ruling in force. The dispute concerned the respondent’s denial of a naturalization claim, where the constitutional complainant challenged the procedural handling of a court decision that partially relied on factually incorrect reasoning regarding when the respondent had learned of the opposing party’s legal stance. The court held that despite these factual errors, the challenged decision did not violate the right to effective legal protection (Art. 19 para. 4 of the German Basic Law) or the right to equality (Art. 3 para. 1 of the German Basic Law), specifically because the complainant continued litigation after the respondent’s defense, which explicitly denied the naturalization claim based on its legal interpretation.

Nichtannahmebeschluss: Keine Grundrechtsverletzung im fachgerichtlichen Verfahren trotz teilweise sachlich unzutreffender Erwägungen
[TENOR]
Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.
[GRUENDE]
