Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court dismissed the constitutional complaint and rejected the motion for recusal of unspecified judges, with the decision being unappealable. The applicant filed a motion for recusal directed generically against "the senates of the Federal Constitutional Court" without providing a comprehensible justification, while also lodging a constitutional complaint. The Court determined the recusal motion was manifestly inadmissible because it failed to name specific judges and lacked a substantial basis, resulting in no judge being excluded from the proceedings and no need for official statements from them. The legal basis for the non-acceptance of the constitutional complaint relied on § 93d(1) sentence 3 of the Federal Constitutional Court Act (BVerfGG), which permits the Court to omit further reasoning when the merits are not taken up.
