Legislator-Zusammenfassung

KI-generiert

The Federal Constitutional Court rejected the urgent application for a preliminary injunction, leaving the exclusion of the applicant political party from the 2025 Bundestag election in force. The dispute concerned a party’s attempt to participate in the federal election despite failing to submit the required participation notice under § 18(2) of the Federal Elections Act (Bundeswahlgesetz). The Court held that the substantive constitutional complaint would be inadmissible from the outset because § 49 of the Federal Elections Act establishes an exclusive remedy scheme for decisions directly affecting the election process, and no specific legal remedy existed within the election laws to challenge the refusal to recognize the party for failing to file the participation notice.
