Non-recognition of political party for election participation: lack of representation authority and legal interest in shortened signature deadlines
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court dismissed the non-recognition complaint filed by the political party "VPD," ruling that the complaint was not validly instituted because it was signed solely by the board chairman, who lacked the authority to represent the party alone, and further failed to meet statutory reasoning requirements. The court also dismissed a separate complaint against the shortening of deadlines for gathering candidate support signatures, finding it inadmissible due to a lack of legal interest, as the petitioner, in its status as a non-recognized party, was not subject to the shortened deadlines. The decision rests on the procedural requirements for valid representation in constitutional complaints under the Federal Constitutional Court Act and the specific statutory definition of recognized political parties under the Federal Elections Act, which determines eligibility for expedited election procedures.

Verwerfung einer Nichtanerkennungsbeschwerde (Art 94 Abs 1 Nr 4c GG, § 13 Nr 3a BVerfGG) wegen fehlender Vertretungsbefugnis des Unterzeichnenden - zudem mangelnde Beschwerdebegründung - hier: Nichtanerkennungsbeschwerde der "Volksstimmen-Partei-Deutschland (VPD)" unzulässig - Tenorbegründung
[TENOR]
