Legislator-Zusammenfassung

The Federal Constitutional Court rejected the applicant’s request for an interim injunction, ruling that the application was inadmissible. The dispute concerned the design of ballots for the 2024 European Parliament elections, where the applicant sought a preliminary order to halt the election process pending a review of the ballot layout. The court held that an election review cannot be front-loaded into interim proceedings because it is statutorily designed as a post-election procedure; consequently, no substantive review of the ballot design was conducted in this instance. The decision relies on Article 41 of the German Basic Law, § 48 of the Federal Constitutional Court Act, and § 26 of the Act on the Election of Members of the European Parliament, which collectively mandate that election scrutiny occurs only after the election has taken place.
