Legislator-Zusammenfassung

The Federal Constitutional Court (Second Senate) dismissed a request to recuse the rapporteur judge as obviously inadmissible and rejected the underlying election review complaint, resulting in a complete victory for the respondent side. The dispute arose from a challenge to the validity of an election and a subsequent motion to recuse the judge responsible for the case, which the complainant supported with an entirely unsuitable justification that failed to substantiate any grounds for bias. The court held that because the recusal request was manifestly inadmissible due to its lack of content, no official statement from the judge was required and the judge could participate in the decision; the election review complaint itself was dismissed pursuant to the reasoning already provided in the rapporteur’s initial letter, with the court relying on § 24 Sentence 2 of the Federal Constitutional Court Act (BVerfGG) to waive a further written explanation.
