Judicial disqualification motion: failure to substantiate willfulness or violation of the constitutional right to a lawful judge
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court rejected the applicant’s request for provisional measures and the associated claim for reimbursement of necessary costs. The dispute concerned an isolated emergency application challenging a lower court’s administrative procedural decision regarding a motion for the disqualification of a judge, which the applicant alleged violated constitutional standards. The court held that the application failed because the applicant did not substantiate that the challenged decisions were manifestly inadmissible or unfounded, nor did they demonstrate an arbitrary denial of justice or a fundamental misapprehension of the constitutional right to a lawful judge under Article 101(1) sentence 2 of the Basic Law; furthermore, any potential breach of the waiting period requirement for disqualification motions under § 54(1) of the Administrative Procedure Code and § 47(1) of the Code of Civil Procedure was deemed cured by the subsequent rejection of the motion.
