Emergency relief for prisoner to initiate parole preparation: failure to substantiate severe disadvantage and subsidiarity
Legislator-Zusammenfassung
KI-generiertThe German Federal Constitutional Court dismissed the application for a temporary injunction and denied legal aid, leaving the respondent's position prevailing as the applicant's immediate relief was refused. The dispute involved a criminal prisoner seeking an order to initiate parole preparation measures, which the court found procedurally deficient. The decisive legal basis for the dismissal was the applicant's failure to substantiate that a severe disadvantage threatened absent the injunction and the failure to demonstrate compliance with the principle of subsidiarity by exhausting other legal remedies, while legal aid was denied due to the lack of a sufficient prospect of success in the intended proceedings.

Erfolgloser Eilantrag eines Strafgefangenen zur Einleitung von Entlassungsvorbereitungen - Tenorbegründung
[TENOR]
