Recusal motion against non-participating judges deemed manifestly inadmissible without substantive review
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court dismissed the constitutional complaint without further reasoning, rendering the request for interim relief moot, and rejected the motion for legal aid and the application for exemption of judges as inadmissible. The petitioner challenged the impartiality of specific judicial officers and sought to review a lower court decision, but the dismissal targeted the procedural defects in the challenge. The court held that a motion for recusal is manifestly inadmissible if the judges identified are not assigned to participate in the specific proceedings at hand, citing the principle that such obviously inadmissible applications require no further substantive review or personal exclusion of the non-participating judges.
