Constitutional Complaint Rejected for Lack of Substantiation and Warning of Misuse Fee
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court of Germany rejected the constitutional complaint as inadmissible and declared the associated application for interim relief moot, effectively ruling against the complainant. The dispute involved a constitutional complaint that was dismissed at the admissibility stage because it failed to meet the requirement of a sufficient substantive justification under §§ 23(1) sentence 2 and 92 of the Federal Constitutional Court Act (BVerfGG), rendering it legally unripe for a merits review. The decision emphasized the strict substantiation standards required for constitutional review and included a procedural warning that future filings lacking such substance may be subject to a misuse fee under § 34(2) BVerfGG if they are found to be abusive, as they hinder the court's ability to provide timely fundamental rights protection to other litigants.

April 2018 - 2 BvR 415/18 u.a.
