Admission of lay assistant in election review proceedings and requirement for objective procedural utility
Legislator-Zusammenfassung
KI-generiertThe German Federal Constitutional Court (BVerfG) dismissed two election review complaints as inadmissible at the threshold, simultaneously rejecting the applicants' motions for the admission of a lay assistant and for legal aid. The dispute concerned a challenge to the validity of an electoral process, initiated by a third party who submitted the application on behalf of the complainants without providing the necessary power of attorney or demonstrating that the involvement of a specialist was objectively necessary. The court held that the admission of a lay assistant under § 26 Abs. 3 Satz 3 EuWG in conjunction with § 22 BVerfGG was refused because the applicants failed to prove the procedural utility and necessity of such representation, and the complaints lacked any prospect of success. Consequently, the application for legal aid was denied for lack of merit under § 114 ZPO, and the substantive claims were rejected with reference to the reasons already set forth in the rapporteur’s letter, resulting in a final dismissal without further detailed reasoning.

[GRUENDE]
Naumann, in: Barczak, BVerfGG, 2018, § 22 Rn. 18).
