Constitutional complaint against the Unified Patent Court Act: rejection based on prior reasoned admissibility assessment
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court refused to accept the constitutional complaints for a decision, thereby denying relief to the applicants and leaving the challenged legislation in force. The dispute concerned the constitutionality of the law implementing the Agreement on a Unified Patent Court, where the complainants challenged the statute's conformity with the German Basic Law. Relying on the reasoning set forth in a prior interlocutory order, the Court found that the complaints were destined to fail and explicitly declined to provide a further reasoned explanation, citing the statutory provision allowing the omission of a detailed justification when the merits are evidently insufficient; the decision is noted as final and not subject to appeal.
