Denial of legal aid and constitutional complaint for failure to demonstrate prospect of success in constitutional review
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court (1st Senate, 2nd Chamber) denied the applicant's request for legal aid and refused to admit the constitutional complaint for decision, thereby upholding the lower court's prior proceedings. The applicant challenged the rejection of their legal aid application, arguing it was required for their intended constitutional review, but failed to demonstrate that the subject of the complaint presented a sufficient prospect of success under Section 114 (1) Sentence 1 ZPO or that a violation of fundamental rights or fundamental rights-equivalent rights was apparent. Relying on Section 93d (1) Sentence 3 BVerfGG, the court dispensed with a further detailed reasoning, as the failure to meet the prerequisites for legal aid necessitated the denial of the main complaint, rendering the decision final and unappealable.

[TENOR]
