Constitutional complaint: denial of legal aid for failure to demonstrate sufficient prospect of success
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court (FCC) declined to accept the constitutional complaint and rejected the applicant's request for legal aid, thereby leaving the lower courts' rulings in force. The applicant challenged the decisions of the Federal Court of Justice, the Nuremberg Higher Regional Court, and the Nuremberg-Fürth Regional Court, which had previously dismissed her civil proceedings and associated provisional measures. The Court denied the application for legal aid and an *amicus* attorney because the applicant failed to meet the specific requirements of § 23 Abs. 1 Satz 2 BVerfGG to demonstrate sufficient prospects of success under § 114 Abs. 1 Satz 1 ZPO, finding no apparent violation of fundamental rights. Relying on § 93d Abs. 1 Satz 3 BVerfGG, the Court omitted a detailed substantive justification for the non-acceptance of the complaint and declared the decision unappealable.
