Judicial determination of subject matter value barred by lack of legal interest following rejection of interim relief
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court dismissed the applicant’s motion for the judicial determination of the subject matter value, ruling that no legal interest (Rechtsschutzbedürfnis) existed to justify the request. The dispute arose from a prior procedural step in which an urgent injunction application was rejected due to insufficient justification, prompting the applicant to seek a specific valuation of the case value. The Court determined that, pursuant to § 37 Abs. 2 Satz 2 RVG, the statutory minimum subject matter value of €5,000 applies to independent proceedings for interim relief, and a higher value is not regularly justified when such applications are refused or withdrawn in the absence of exceptional circumstances. Since the standard minimum value was applicable, the applicant lacked a sufficient interest in seeking a judicially determined amount, rendering the motion inadmissible.

September 2021 - 2 BvR 1427/21 -).
Diese Entscheidung ist unanfechtbar.
