Manifestly unsubstantiated constitutional complaints: procedural inadmissibility and risk of abuse fee under § 34 Abs. 2 BVerfGG
Legislator-Zusammenfassung
KI-generiertThe Federal Constitutional Court rejected a series of joint constitutional complaints as manifestly inadmissible, leaving the complainant without relief and rendering the associated applications for interim relief moot. The case involved a single complainant who filed multiple constitution complaints and unfounded requests for interim injunctive relief that failed to meet the substantive requirements for justification and did not adequately demonstrate the urgency required for such provisional measures. The Court based its decision on the provisions of the Federal Constitutional Court Act, specifically finding that the complaints did not satisfy the admissibility prerequisites and that the submissions were substantively empty and obviously futile. In its disposition, the Court noted that such manifestly insufficient filings can constitute abuse of process, potentially subjecting the complainant to an abuse fee under the relevant statutory provisions for interfering with the Court's operations and delaying justice for other petitioners.
